Exemption: Content Produced by Third Parties

For the purposes of 18 U.S.C. § 2257, the owners and operators are not the primary or secondary "producers" of any content containing explicit sexual conduct, real or simulated, displayed on the website. The operator of hdmaturetube.com restricts their activities with regard to sexually explicit content furnished by third-party users to transmission, storage, retrieval, hosting, or formatting only. The areas of hdmaturetube.com on which user contributed content is presented are under the control of those users. The operators of hdmaturetube.com are therefore free from compliance with Section 2257 records keeping and labeling obligations as set out in 28 C.F.R. §75.1(c)(4). Part 75 for one or more of the following reasons: (1) the images or videos do not portray any sexually explicit acts as laid out in 18 U.S.C. § 2256(2)(A); (2) the images or videos do not portray depictions of the genitals or pubic area after July 27, 2006; (3) the images or videos do not portray simulated sexually explicit behavior; or (4) the images or videos were shot before July 3, 1995.
